Congress passed H.R. 5569, which extends the NFIP through September 30, 2010. The President is expected to sign the bill today. The extension is retroactive to May 31, 2010. Because of the NFIP hiatus from June 1, 2010, through July 1, 2010, renewal offers could not be sent to policyholders. When confirmation of the bill signing is received, NFS will begin processing new business, renewals and endorsements. For those policies whose renewal offers were not sent during the hiatus, the grace period is extended the number of days that the renewal offer was delayed. This I a little good news for those affected by the hiatus, albeit only a temporary solution.

We have all been waiting with baited breathe to see how the new federal legislation signed into law by Pres. Bush would effect sellers who financed some or all of their properties in the State of Texas. The new laws would significantly restrict the ability or sellers ability to finance the sale of property.  

Well there is good news and bad news. The good news is the wait is over. The bad news is there are still new restrictions we must deal with if we intend to finance the sale of property.

As it stands now, the commissioner of the Texas Department of Savings and Mortgage Lending has taken steps to allow Texas property seller owners to continue to seller finance up to five transactions in a 12-month period. As well, the commissioner has delayed the implementation of the SAFE Act requirement for licensure in seller-financed transactions in Texas until August 31.

However, for now it is important to know that the long-standing law of allowing a Texas seller to finance up to five transactions in a consecutive 12-month period is still in effect.

This law has stirred a lot of emotions due to the current downturn of the market. Some feel they will have their hands tied and in effect would put them out of business. These Texas sellers are offering a solution to a problem that most lenders shy away from. If this legislation is allowed to be put into force as it is written, it will cause additional stress on the already over stressed Texas Real Estate market.

As of midnight May 31, 2010 Congress has failed to pass H.R. 4213 that would re-authorize the NFIP (National Flood Insurance Program)

Although the initial thought is the laps is expected to be brief, no one can predict in entirety the fallout of this action. Or in-action as is it could be stated.

Basically, if you have a home that currently has flood insurance, that policy will stay in force. If you have a claim that claim would be paid per your policy. However, if your policy is up for renewal it would not be renewed. As well no new policies can be written.

This affects 5.6 million policy holders. 

This is causing many settlements to be delayed or even put off entirely. It is also creating problems for homeowners when their flood policy comes up for renewal. Mortgage companies require flood insurance if the property is located in the flood plain. Just because the property was covered when the mortgage was taken out does not mean the renewal is guaranteed.
